What are the time limits in which to bring a claim?

You must bring a claim within 3 years of the date of the alleged negligence.

Alternatively, you may bring a claim 3 years from the date that you knew or ought to have known that you had a potential claim.

This can become complicated and your legal advisor will discuss this further.

If the claim is on the behalf of a child, legal proceedings should be brought 3 years after their 18th birthday, i.e. before their 21st birthday.

It is important to remember, the 3 year limitation period will run during your service.  You must not wait until you are discharged to bring your claim; you may find that the 3 year period has expired.  You may be told that you cannot pursue a claim whilst a serving member of the Armed Forces.  That is incorrect.

How will my claim be funded?

If our Lawyers accept your claim, your case will be funded by way of a No Win No Fee agreement. If you loose, you pay nothing.

Should you win your case, the opponent will pay your costs. This is the case as long as you act reasonably throughout your claim. Your Lawyer will explain this to you.

For Medical Negligence Claims, you may, in certain instances, be asked to pay any disbursements which arise throughout the case. Disbursements include copy medical records and experts’ reports. If your legal advisor has taken insurance out then if you lose your case you will receive anything that you have paid back.

If you win your case, regardless of any insurance policy, you will recover your disbursements from the Defendant together with your legal advisor’s costs.

How much compensation will I receive?

Your Lawyer will discuss this with you. It will depend on how serious your injury was and how much you have lost through being off work etc
